1. Agreement
to Terms and Conditions
This website and domain name
are owned by
Eponia Gifts ABN 76 801 835 177 (Eponia).
By
accessing and using www.eponiagifts.com.au (Site)
users (Customers) agree to be bound by the following
terms and conditions (Terms).
Eponia may change the Terms
at
any time. All
changes will be posted on the Site. Customers are responsible for
keeping up to
date with these Terms. Continued use of the Site after any changes are
made
constitutes acceptance of those changes.
2.
Products
(a) Handcrafted
Goods
Eponia’s
products include
handcrafted
items
from different parts of the world. Some items may contain
small imperfections
and minor variations in design and colour. These
characteristics make each
piece unique and are part of their handcrafted charm. Many of these
items are decorative only and should be
treated as such.
(b) Colour
Variations
Slight variations may occur in colours as a
result of screen resolution and individual monitor settings.
(c) Measurements
All measurements
are an approximate guide only.
3.
Right of Cancellation
Orders
are subject to availability of stock.
Eponia reserves the right to cancel any order. Customers will
be notified by
email of any cancellations.
4.
Payments
All
prices are
in Australia Dollars and include 10%
GST.
Prices are
subject to change
without notice.
(a)
Australian Customers
Payments can be made in the
following
ways:
(i) VISA or MASTERCARD via the online shopping
cart.
(ii) EFT or MONEY ORDER upon prior
arrangement.
Please email items you are interested in.
(iii) IN
PERSON
at our retail store in Torquay.
Internet items
are not
kept at our retail store. Please email first.
(b)
International Customers
Payments by
VISA or MASTERCARD via the online shopping cart only. International customers
will not be charged
GST on ordered goods.
(c)
Full
Payment Required
Until
full payment is received;
(i)
all
goods remain the property of Eponia, and
(ii)
orders
will not be posted.
5.
Postage and Handling
(a)
Shipping
and Insurance
All
orders are dispatched from Torquay,
Victoria,
via Australia Post. Eponia
ships worldwide. Unless
requested items are not insured. Customers requiring insurance
should note this in the Order Comments and Special Request Box
at check out or send a separate email
at
the time of order placement.
(b) Postage
Calculation.
Postage
is calculated on an individual basis. Once an order is placed Customers
will be emailed the Final Order Cost.
Final
Order
Cost =
price of item(s) +
postage and handling.
Orders will
be charged and dispatched
once Eponia has received Customer acceptance of the Final
Order Cost. Eponia reserves the
right to cancel an order where Customers have not
accepted
the Final Order Cost within 5 days of
notification.
6.
Credit
Card Processing
Credit
Card information is transmitted to Eponia using a 128 – bit
encryption Secure
Socket Layer (SSL). To
protect
against fraud, do not email credit card details.
All credit card
transactions are processed offline. Credit cards are not debited at
time of check
out. Orders are
processed manually using an EFTPOS machine upon receipt of Customer
acceptance of the Final
Order Cost.
7.
Refunds
(a)
Faulty or Incorrectly Described
Goods
Refunds
will
only be given where
the Customer can show proof of purchase and prove that
the product is:
(i) faulty,
(ii) not doing what
it’s supposed to do, or
(iii) significantly
different to what was shown or described.
Requests
for refunds will not be considered after 7 days from receipt
of
goods.
(b)
Changing your Mind
Customers are
not entitled to a refund simply because they have changed their
mind.
In
such cases Eponia
will issue
refunds on a discretionary basis. Postage
and delivery costs are non- refundable.
DO NOT
send
goods back to Eponia without first contacting us.
8.
Privacy
Eponia
is
committed to protecting the personal privacy of it’s
customers.
Personal data is collected
for the processing of
orders and where Customers
have opted to join the mailing list. This
information will not be disclosed
to third parties unless required to by law.
9.
Copyright
The
Site and
its contents are subject to
copyright. Unless otherwise indicated this copyright is owned
by
Eponia. Customers
may download content from the Site or make hard copies
for personal non-
commercial use only.

Links

Third
Party Sites
The
Site may
contain links to third party websites.
Access to theses sites and/or use of that site’s products and
services is solely
at the Customer’s own risk. Eponia does not control, endorse,
sponsor
or
approve any such websites or any content on them.

Linking to

Links to the
Site
without prior permission are prohibited. If you wish to link to our
Site please send an
email with the URL you
wish to link from and a brief description of
the website.
11.
Limitation of Liability and Indemnity
(a) Items
in Transit
Eponia
does not accept responsibility
for delays in delivery or for items
lost, damaged or stolen in transit.
For
goods delivered outside of Australia Customers
will be the importer
into the destination country and responsible for customs clearance,
payment of customs duties and local
taxes.
(b) Loss
or
Damage
Accessing
and use of the Site and reliance on the contents is done at the
Customer’s own risk. Subject
to
applicable law Eponia shall not be liable
for
loss or
damage of any kind (including by
negligence)
arising from or relating to the content
and/or use of the Site.
(c)
No
Warranties
To
the extent
permitted by law Eponia makes no
representations or warranties of any kind, express
or implied as to the
operation of the Site or the information, content, materials
or products included on the Site.
(d)
Indemnity
The
Customer
agrees to indemnify and keep
indemnified Eponia for any loss, costs, claims, liability
or responsibility,
which may arise against them or any third party as a result of their
use of the
Site or content.
12.
Jurisdiction
This
agreement
shall be governed
by the laws in force in the State of Victoria, Australia. Customers
hereby
submit to the exclusive jurisdiction of the courts of that State.
